DATENSCHUTZERKLÄRUNG

• Der Schutz der personenbezogenen Daten des Käufers, der eine natürliche oder juristische Person ist, wird durch das Gesetz Nr. 101/2000 Slg. über den Schutz personenbezogener Daten in seiner geänderten Fassung gewährleistet.
  • Der Käufer ist mit der Verarbeitung folgender personenbezogener Daten einverstanden: Vor- und Nachname, Wohnanschrift, Identifikationsnummer, Steueridentifikationsnummer, E-Mail-Adresse, Telefonnummer. (im Folgenden zusammenfassend als „personenbezogene Daten“ bezeichnet).
  • Der Käufer erklärt sich mit der Verarbeitung personenbezogener Daten durch den Verkäufer zum Zwecke der Ausübung der Rechte und Pflichten aus dem Kaufvertrag einverstanden. Sofern der Käufer nicht anders wählt, willigt er auch in die Verarbeitung personenbezogener Daten durch den Verkäufer zum Zwecke der Zusendung von Informationen und kommerziellen Mitteilungen an den Käufer ein. Die Zustimmung zur Verarbeitung der personenbezogenen Daten in ihrer Gesamtheit gemäß diesem Artikel ist keine Bedingung, die an sich den Abschluss des Kaufvertrags verhindern würde.
  • Der Käufer nimmt zur Kenntnis, dass er verpflichtet ist, seine persönlichen Daten (bei einer Bestellung aus dem Webinterface des Shops) korrekt und wahrheitsgemäß anzugeben und dass er verpflichtet ist, den Verkäufer unverzüglich über jede Änderung seiner persönlichen Daten zu informieren.
  • Der Verkäufer kann die Verarbeitung der personenbezogenen Daten des Käufers an einen Dritten als Auftrags Verarbeiter delegieren. Mit Ausnahme der Personen, die die Ware transportieren, werden personenbezogene Daten vom Verkäufer ohne vorherige Zustimmung des Käufers nicht an Dritte weitergegeben.
  • Die personenbezogenen Daten werden auf unbestimmte Zeit verarbeitet. Personenbezogene Daten werden in elektronischer Form auf automatisierte Weise oder in Papierform auf nicht automatisierte Weise verarbeitet.
  • Der Käufer bestätigt, dass die angegebenen persönlichen Daten korrekt sind und dass er darüber informiert wurde, dass es sich um eine freiwillige Angabe von persönlichen Daten handelt.
  • Ist der Käufer der Ansicht, dass der Verkäufer oder der Auftragsverarbeiter eine Verarbeitung seiner personenbezogenen Daten vornimmt, die dem Schutz des Privat- und Persönlichkeitslebens des Käufers zuwiderläuft oder gegen das Gesetz verstößt, insbesondere wenn die personenbezogenen Daten im Hinblick auf den Zweck ihrer Verarbeitung unrichtig sind, kann der Käufer:

vom Verkäufer oder Verarbeiter eine Erklärung verlangen,

den Verkäufer oder Verarbeiter zur Abhilfe auffordern.

Verlangt der Käufer Auskunft über die Verarbeitung seiner personenbezogenen Daten, ist der Verkäufer verpflichtet, ihm diese Auskunft zu erteilen. Der Verkäufer ist berechtigt, für die Bereitstellung der Informationen nach dem vorstehenden Satz eine angemessene Gebühr zu verlangen, die die für die Bereitstellung der Informationen erforderlichen Kosten nicht übersteigt.

DATA PROTECTION

o The protection of personal data of the buyer, who is a natural or legal person, is provided by Act No. 101/2000 Coll., on the protection of personal data, as amended.

o The buyer agrees to the processing of the following personal data: name and surname, residential address, identification number, tax identification number, e-mail address, telephone number. (hereinafter collectively referred to as „personal data“).

o The Buyer agrees to the processing of personal data by the Seller for the purpose of exercising the rights and obligations under the Purchase Agreement. Unless the Buyer chooses otherwise, the Buyer also consents to the processing of personal data by the Seller for the purpose of sending information and commercial communications to the Buyer. Consent to the processing of personal data in its entirety according to this article is not a condition that would in itself prevent the conclusion of the purchase contract.

o The Buyer acknowledges that he is obliged to provide his personal data (when placing an order from the web interface of the shop) correctly and truthfully and that he is obliged to inform the Seller without undue delay of any change in his personal data.

o The Seller may delegate the processing of the Buyer’s personal data to a third party as a processor. Except for the persons transporting the goods, personal data will not be passed on to third parties by the seller without the prior consent of the buyer.

o Personal data will be processed for an indefinite period of time. Personal data will be processed in electronic form in an automated manner or in hard copy form in a non-automated manner.

o The purchaser confirms that the personal data provided is accurate and that he/she has been informed that this is a voluntary provision of personal data.

o In the event that the Buyer believes that the Seller or the Processor is carrying out processing of his/her personal data which is contrary to the protection of the Buyer’s private and personal life or contrary to the law, in particular if the personal data is inaccurate with regard to the purpose of its processing, the Buyer may:

request an explanation from the seller or processor,

require the seller or processor to remedy the situation.

o If the buyer requests information about the processing of his/her personal data, the seller is obliged to provide him/her with this information. The seller has the right to charge a reasonable fee for the provision of the information under the previous sentence, not exceeding the costs necessary to provide the information.

OCHRANA OSOBNÍCH ÚDAJŮ

• Ochrana osobních údajů kupujícího, který je fyzickou či právnickou osobou, je poskytována zákonem č. 101/2000 Sb., o ochraně osobních údajů, ve znění pozdějších předpisů.
  • Kupující souhlasí se zpracováním těchto svých osobních údajů: jméno a příjmení, adresa bydliště, identifikační číslo, daňové identifikační číslo, adresa elektronické pošty, telefonní číslo. (dále společně vše jen jako „osobní údaje“).
  • Kupující souhlasí se zpracováním osobních údajů prodávajícím, a to pro účely realizace práv a povinností z kupní smlouvy. Nezvolí-li kupující jinou možnost, souhlasí se zpracováním osobních údajů prodávajícím také pro účely zasílání informací a obchodních sdělení kupujícímu. Souhlas se zpracováním osobních údajů v celém rozsahu dle tohoto článku není podmínkou, která by sama o sobě znemožňovala uzavření kupní smlouvy.
  • Kupující bere na vědomí, že je povinen své osobní údaje (při objednávce provedené z webového rozhraní obchodu) uvádět správně a pravdivě a že je povinen bez zbytečného odkladu informovat prodávajícího o změně ve svých osobních údajích.
  • Zpracováním osobních údajů kupujícího může prodávající pověřit třetí osobu, jakožto zpracovatele. Kromě osob dopravujících zboží nebudou osobní údaje prodávajícím bez předchozího souhlasu kupujícího předávány třetím osobám.
  • Osobní údaje budou zpracovávány po dobu neurčitou. Osobní údaje budou zpracovávány v elektronické podobě automatizovaným způsobem nebo v tištěné podobě neautomatizovaným způsobem.
  • Kupující potvrzuje, že poskytnuté osobní údaje jsou přesné a že byl poučen o tom, že se jedná o dobrovolné poskytnutí osobních údajů.
  • V případě, že by se kupující domníval, že prodávající nebo zpracovatel provádí zpracování jeho osobních údajů, které je v rozporu s ochranou soukromého a osobního života kupujícího nebo v rozporu se zákonem, zejména jsou-li osobní údaje nepřesné s ohledem na účel jejich zpracování, může:
    • požádat prodávajícího nebo zpracovatele o vysvětlení,
    • požadovat, aby prodávající nebo zpracovatel odstranil takto vzniklý stav.
  • Požádá-li kupující o informaci o zpracování svých osobních údajů, je mu prodávající povinen tuto informaci předat. Prodávající má právo za poskytnutí informace podle předchozí věty požadovat přiměřenou úhradu nepřevyšující náklady nezbytné na poskytnutí informace.
